Please read these terms carefully. By using Youcaps.ai, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Agreement & Acceptance

1.1 Binding Agreement

By accessing, browsing, or using Youcaps.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1.2 Eligibility

• You must be at least 16 years old to use this Service
• You must be a legal resident of the European Union, UK, or Switzerland
• You have the legal capacity to enter a binding contract in your jurisdiction
• If you're under 18, you must have parental/guardian consent

2. Service Description

2.1 What We Provide

Youcaps.ai is a subscription service that:

• Collects your health and wellness information via questionnaire
• Uses artificial intelligence to analyze your data
• Recommends personalized dietary supplements
• Manages recurring supplement shipments to your address
• Provides customer support for account and subscription issues

2.2 Service Limitations

Important: Always consult a licensed healthcare provider before starting new supplements, especially if you have existing health conditions or take medications.

2.3 AI-Powered Personalization

Our recommendations are generated by an artificial intelligence algorithm that:

• Analyzes your health questionnaire responses
• Cross-references supplement ingredients with your medications and allergies
• Considers your fitness goals and dietary preferences
• Generates personalized product suggestions

Limitations:

• AI is not perfect; recommendations may not be appropriate for all users
• AI may miss certain drug/supplement interactions
• You are responsible for reviewing recommendations with your healthcare provider
• We disclaim liability for AI recommendations (see Section 6)

3. Subscription Terms

3.1 How Subscriptions Work

A Youcaps.ai subscription includes:

• Monthly shipment of personalized supplements
• AI-generated recommendations tailored to your profile
• Access to your health dashboard (view/edit profile, access data)
• Email support (response within 24–48 hours)
• Ability to pause/cancel anytime

3.2 Pricing & Billing

Pricing	Displayed before purchase; subject to change with 30 days' notice
Billing Cycle	Monthly or Annual (user's choice)
Payment Methods	Credit/debit card, iDEAL, PayPal, Bank transfer
Currency	Euros (€)
Failed Payments	We attempt 2 retry charges (3–5 days and 8–10 days later)

3.3 Recurring Billing

You authorize Youcaps.ai to:

• Charge your payment method on a recurring basis (monthly or annual)
• Adjust charges if prices change (with 30 days' notice)
• Process charges on the same date each billing cycle

You can:

• Pause your subscription for up to 3 months
• Cancel anytime (no cancellation fee)
• Change your billing cycle (monthly to annual or vice versa)

3.4 No Refunds Policy

Supplements are non-refundable once shipped. However:

You cancel before shipment is processed	Full refund of charge
You cancel after shipment, before delivery	Non-refundable (may request return for credit)

3.5 Subscription Pause & Cancellation

Pause:

• You can pause your subscription for 1–3 months via dashboard
• No charge during pause period
• Subscription resumes on your specified date

Cancellation:

• You can cancel anytime via dashboard (Settings > Subscription > Cancel)
• Cancellation is effective immediately
• No refund for current month's charge (unless cancellation is before processing)
• Your account data is retained per Privacy Policy

6. Limitation of Liability

Youcaps.ai does not warrant that:

• AI recommendations are medically appropriate for you
• Recommendations will be effective for your goals
• Recommendations account for all possible interactions with your medications
• Recommendations account for all of your health conditions

Youcaps.ai is not liable for:

8. Governing Law & Dispute Resolution

8.1 Governing Law

These Terms are governed by Dutch law and the General Data Protection Regulation (GDPR) as applied in the European Union.

8.2 Jurisdiction

Disputes shall be resolved in the following order:

1. Informal Resolution (30 days):

• We will attempt to resolve in good faith within 30 days
• You may request a call or written response

2. Escalation (optional):

• If unresolved, request escalation to management
• We will provide contact information for formal dispute process

3. Legal Proceedings:

• If unresolved, disputes may be brought before Dutch courts (Amsterdam District Court)
• Arbitration clause: Parties may mutually agree to arbitration instead
• Consumer disputes may be brought before your local court or alternative dispute resolution (ADR) body

8.3 EU Consumer Rights

If you are a consumer (resident of EU for personal use), you have statutory rights that cannot be waived:

• Right to fair contract terms (no unfair terms allowed)
• Right to cooling-off period: 14 days to cancel for any reason (for distance contracts)
• Right to complaint with national consumer authorities

Cooling-Off Right Details:

• You have 14 calendar days from account creation
• To exercise: Email [email protected] with cancellation request
• Refund processed within 14 days
• If supplements already shipped, they are still returnable under cooling-off right
